Definition of a Probate Attorney

A probate attorney can also be called a probate lawyer, estate lawyer, or estate attorney. They are responsible for taking an Executor through the probate process. An Executor is somebody who was appointed by the deceased before they died. This may be a loved one, friend, or even the probate attorney themselves. The process will depend on many factors, including where the deceased lived when they died and where they owned real estate.

Different things can happen depending on whether there was a will or not too. It is a lot easier if there is a will. Here are some of the things a probate attorney can help with:

  • Giving out what’s left of the deceased’s assets.
  • Retitling real estate to the beneficiaries.
